General Terms of Sales of Educate.me sarl-s

1. Definitions

In this agreement, "Educate.me", "we", "us", or "our" refers to Educate.me sarl-s, a company incorporated under the laws of Luxembourg providing online language instruction. "Customer", "you", or "your" refers to the individual or group enrolling in and paying for our courses.

2. Acceptance of Terms

By enrolling in a course and paying the associated invoice, you agree to be bound by these General Terms of Sales, our Privacy Policy, and any other relevant policies and notices which may apply to the use of our services.

3. Description of Services

We offer online individual and group language courses, structured in accordance with the Common European Framework of Reference for Languages (CEFR). We also offer bespoke language courses tailored to meet individual requirements. To enroll, you must provide your first and last name, email address, phone number, country of residence, the course you wish to enroll in, and a self-assessment of your current language proficiency through an explicit request via email, phone, or messenger. We may also recommend a test class with a teacher or in one of the existing groups to more accurately assess your language level.

4. Attendance and Certification Clause
  • Certificate of Attendance for Citizenship Courses: Upon completing a Luxembourgish language course accredited by the Ministère de l'Éducation nationale, de l'Enfance et de la Jeunesse, specifically designed for citizenship preparation, students will receive a Certificate of Attendance. This certificate will state the total number of classes attended. Attending at least 24 classes is necessary to meet the requirements set forth by the loi du 8 mars 2017 sur la nationalité luxembourgeoise. This attendance is crucial for eligibility for government reimbursement (up to €750) and the successful citizenship application.
  • General Certificate of Attendance: Certificates of attendance are also issued for all other courses upon request, without any special attendance conditions. These certificates will always mention the actual number of classes attended by the student.
5. Course Adjustment Clause

Educate.me reserves the right to change the tutor and/or the time schedule at any point during the course. You will be notified of any such changes in advance. This ensures the continuity and quality of instruction, adapting to the evolving needs of both students and staff.

6. Payment Terms

Educate.me offers flexible payment options:
  • Full Payment Upfront: Complete the payment for the entire course in one transaction to potentially receive a discount. Full payment is due upfront to confirm enrollment.
  • Split Payment: Spread the cost over two or three installments. The first installment is required upfront to confirm enrollment, with subsequent payments scheduled midway or two-thirds into the course.
  • Subscription Payment: This option involves a weekly payment that starts from the second week of the course. A booking fee, covering the first and last weeks, is required to confirm enrollment. Payments are continuous, regardless of holidays or rescheduled classes, until the full course fee is covered.
Enrollment is secured once the initial payment for the chosen payment method is received. Failure to adhere to the payment schedule may affect access to the course.

7. Cancellation and Refund Policy

In compliance with Luxembourgish law, you have the right to cancel your enrollment within 14 days of payment, without providing any reason. This cancellation period expires 14 days from the day the contract is concluded. To exercise your cancellation rights, you must notify us by a clear statement (e.g., a letter sent by post, fax, or email). Refunds are only issued for classes that have not been taken. Refund requests must be made within 14 days of the first payment.

8. User Rights and Obligations

As our customer, you are expected to provide accurate information upon enrollment, act responsibly, and behave appropriately during classes. Students enrolled in individual courses have the right to request to cancel or reschedule a class, provided they inform us no later than 24 hours before the scheduled class time. If a student fails to notify us of a cancellation and does not attend a scheduled class, the class will be considered delivered and will be billed accordingly.

9. Intellectual Property Rights

All course materials provided are owned by or licensed to us and are subject to copyright and other intellectual property rights under Luxembourg and foreign laws and international conventions.

10. Limitations and Disclaimers

We strive to provide high-quality service but cannot guarantee that our services will meet your expectations or that the use of our services will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

11. Privacy

Please refer to our Privacy Policy for information regarding the collection, use, and storage of your personal data. By agreeing to these General Terms ofSales, you also agree to our Privacy Policy.

12. Termination

We reserve the right to terminate or suspend your access to our services for any reason not prohibited by law, including breach of these General Terms of Sales.

13. Dispute Resolution

Any dispute arising from these terms will be governed by the laws of Luxembourg and should be resolved in the jurisdiction of Luxembourg.

14. Changes to the Terms

We reserve the right to amend these General Terms of Sales at any time by posting a revised version on our website. Your continued use of our services following any changes constitutes your acceptance of these amendments.
